Domestic Violence and Child Custody

What are the chances of me getting sole custody of my son if I ask for that. His father is currently incarcerated until his court date stemming from second assault/domestic violence charges and felony harrassment, they are also trying to ''stack'' more charges (illegal possession of a firearm, and some other stuff) I also have a TRO. Does he have a leg to stand on in court?

Your chances are quite good. The fact that he is abusive and violates the restraining order indicates that he is not making good decisions in regard to you or your son. Having an attorney represent you would increase the probability of success.
