Domestic Violence, Drug Abuse and Custody

My ex-husband has several charges for domestic violence, and drug abuse. These incidences happened 4 years ago. My 13 year old daughter decided she wants to live with him. I told here to go for the summer to decide if it was what she really wanted. She decided to stay. She also just started school there. I now find out there is still domestic violence with his new partner and alcohol abuse, but no proof. We are going to court on it, what are the chances they will return custody to me and order supervised visitation, my 8 years old refuses to see him. He also abandoned our children for 2years. Any advice in preperation would be helpful.

As you can see from Mr. Stone's response you are fighting a difficult battle. You must carefully present your case to avoid this response. Unless you have some evidence of the alcohol use and/or the violence your best approach may be to not do any thing.
