Legal Question in Family Law in California

Hi, I am domestic violence victim. I did not request for restraining order against my husband. We have two kids and I do not want them not to see their father.Originally I am from Ukraine and now I have family emergency and I need to travel to see them ASAP. My question is - If i will not show up at the court whether the judge can issue restraining order automatically against my husband for long time.

My husband went to surrender and was bailed out for 25 000$. His case is 273.5 F (2 counts)

Please , let me know about whether or not my husband will get restraining order

He may get a restraining order regardless of whether or not you go to court. Your best bet is to talk to the DA who can tell you whether or not a restraining order. Is likely to be issued. You should make it clear that you do not want a restraining order but you should also ask whether one is likely to be issued despite your wishes. If you are unable to get ahold of the DA assigned to your husband's case talk to the supervisor or a victim's advocate in the office.
