Can a DUI keep a mother from getting custody of children

Girlfriend left her husband, has two children. Mentaly obusive relationship. Girlfriend trying to leave about a month ago, packed her things and was heading to new home. Before she left, she had a margaria after eating nothing so far that day. She left and at 5:00pm hit a block wall in her subdivision and was charged with a D.U.I.. Now after going through marriage counceling has once again desided to leave. My question is, can her husband gain custody over their children due to her possible DUI conviction.

The DUI will be one of the factors that the judge considers when awarding custody. It would be a major factor if the child were with mother at the time of the accident. Good Luck, Pat McCrary
