Legal Question in Family Law in California

DV-110 restraining order to serve

For the last four years I have had full legal and physical custody and xwife refuses to abide by order. She showed up at my house unannounced. I sent her a polite letter in July asking her not to come to my home without my knowledge or consent and called her too. dr's recommendations. My son suffers from Post Traumatic Stress Disorder and was freaked out to see her at the door as he knew she was not to be at our house. The door was closed on her and she preceded to yell for my wife. Door was answered and she was ''intoxicated''. Asked to leave she left. She lost custody for two felony drug arrests. I tried to be nice by allowing her to be with her son under certain circumtstances but her conduct has gone out of control. She has made many repeated phone calls that we have had to change our number on more than one occasion she violates the instructions I give her when I allow her visitation, per my discretion per court order. She refuses to adhere to the advise of my son's psychiatrist (son 13). When I went to file RO I was told that she had just filed for modification for custody and visitation. I have not been personally served yet. SHOULD I GO FORWARD WITH RO I DO NOT WANT TO COMPROMISE MY POSITION. MOTHER MAY BE BACK ON DRUGS

Re: DV-110 restraining order to serve

You should file for the restraining order. Request that she have no contact with your son, wife and yourself. Further that all visitation is to be supervised by a professional supervisor. You should be able to get this restraining order if it is properly presented to the court. This if she appears at you home the police can be called and she will be arrested.
