Legal Question in Family Law in California

DVRO ammended?

Good Morning..

I have a DVRO against my ex. He has been fighting it...hates it! and is dragging the fam. law property settlement issue to the moon. Says everything is gone.. he cant work because he's been ruined by the DVRO... and won't ''help me'' unless I drop the DVRO. I don't and won't drop the restraining order: he' is in contempt.. numerous times ( yes, I've contacted the Sheriff's every single time.. he always walks w/ an alibi ) but now he's blown off the anger managment re. classes. Say's there's no ''f-cking way'' he'll go. Isn't that contempt? Can I go back to the judge that issued the DVRO... have the contempt issues showed to HIM, ask for the R.O to be extended ( was going to be asked and suggested by the crisis center anyway ) AND see if the spousal support can be added in THIS court.... can this be done? Thank you for your time!--name removed---name removed-- stuck in the boonies a.k.a. Calaveras County, Sierras

Re: DVRO ammended?

You should contact the crisis center for assistance. Different courts and counties have different attitudes about DVRO and how they should be dealt with. However, law enforcement should be arresting him for violating the terms of the restraining order. If the local law enforcement agencies don't take these violations contact the state attorney generals office and ask for help.
