Legal Question in Family Law in California
Effectiveness of contempt action
This is re a family law case in CA, L.A. County. My ex wife frustrated my visitation rights by not paying her phone bill, so it interfered with my right to daily phone contact with my son, as allowed per court order, for a week straight. She also didn't follow orders to initiate a parent conference with me during the same week. I can prove all the elements of a contempt, but a local atty tells me the judge (Judge Black, Dept A in Long Beach) isn't going to find for contempt, likely over definition of ''willful''. Other than crying ''frustration'' in a separate OSC for a modification -- which I don't think will change much, without contempt in the mix -- what are my options? My ex wife finds it most convenient to keep her head in the sand about stuff, and i don't want sixteen more years of this.

Re: Effectiveness of contempt action
Judge Black is very popular with attorneys. He's a straight shooter and knows what he's doing. Contempt probably wont fly. If you ex is violating orders, frustrating your visits, an OSC might be the right path. You probably wont get much, but the ex will get tired of going to court and correct her behavior.
