Legal Question in Family Law in California

emancipation - definition of

My divorce agreement states, in part, that my child support terminates when my daughter is emancipated or turns 18 years of age. The question is if my daughter moves out of her custodial parents home and lives on a college campus while attending school there and does so prior to her 18th birthday is she, at that point, considered emancipated. If so, does my child support terminate when she takes up residence at the university or do I continue child support payments until she turns 18?

Re: emancipation - definition of

If your daughter is self supporting she may well be considered emancipated. If not, she is just away at school.
