Legal Question in Family Law in California

Emergency Custody Agrrement

To Whom It May Concern:

I need legal assistance regarding my recent relocation and custody of my son. I was married in California and recently moved to Tennessee. I moved out of state with my son with consent of his father with the understanding that my son would return to California to finish the school year. I now fear that my husband will flee with my son if I return him to California, and I need to know what legal standing I have and what actions I can take to ensure my son will return to Tennessee upon completion of this school year. I am not able to pursue legal action in Tennessee because I have not resided here for a six month period. Please contact me with whatever information you are able to provide to me, as of now I dont know how to handle this.

Thank you,

Re: Emergency Custody Agrrement

You apparently reached in writing a legally binding agreement that you would return your son back to California so why do you now think you should make yourself act in a potentially jail causing way because you are convinced your child is facing hidden abduction if returned to his father per court enforceable agreement? You need to either take the matter back to a California court, which you can for the most part do via telephone/email to change the existing decision before it comes due, or you need to follow the agreemnt you already reached.
