Emmotional Abuse

I believe that my step daughters mother is emmotionally abusing her. Can we obtain any more custody because of this? I have documented proof of emmotional abuse. Do we need to go in on Ex-Parte actions. I would like to remove the child from her mother because of the harmful things her mother is saying to her. Right now we have 50% custody can we get another 50% or 25% because of the abuse her mother is doing to her?

You may or may not be able to do that. You just build your case, file with the court a see who wins. There is not enough information here to tell you what your chances will be. You cannot do it ex parte, it requires a full blown hearing.
