Emotionally abused 15yo - need help!
This is tough - I'm in Los Angeles, my 'ex' has sole custody of our son and lives in NJ. She's pawned him off on her relatives and now threw him into an all-boy boarding school in PA. He's miserable, she won't let him come home for the weekend. He wants to get thrown out of the school so he can come home. She said if he does, she'll throw him in one of those boarding homes for juvenile delinquents + drug users who will ''hurt him''. He wants to live with me as his mom constantly emotionally abuses him. She found a doctor who writes prescriptions for whatever she wants - he's on Ability (mood stabilizer) and Focalin (Ritalin-like). Consumer Affairs / Medical Board currently is petitioning to revoke his medical license for gross negligence and incompetance (a patient lost her life because of this doctor)... he's in Los Angeles, the child lives in NJ (now boarding in PA), yet this doc will see him twice/year as an interstate patient - doesn't care what the child has to say, yet he's an adolescent psychiatrist. HELP!!

Yes, you will need an Order to Show Cause for Modification, however, there are some questions that need to be answered first. What state rendered the dissolution judgment? Has custody been modified in another state? Do you have joint legal custody? If you have joint legal custody, there are some things you can do regarding the doctor and the school, etc. When does this doctor see your son? Is the next appointment coming up soon? That could potentially have a strong bearing on the case. But in the meantime, I'd file a complaint against this doc.

You need to bring an motion to modify the child custody. You should get an attorney you will need it to protect your son. The motion will need to be filed in California, if California is the state of the current custody order or in NJ, if that is her home state. Good Luck, Pat McCrary

You need to file an OSC to modify the custody arrangement. Where was your orginal case?
