Employer offers Health Ins. to same-sex domestic partners but not opposite-sex

I work for a very large corporation that offers Health Insurance benefits to same-sex domestic partners. I have been living with my opposite-sex domestic partner for 8 years now, but the company has informed me from a specific personal inquiry that my partner is not eligible for health benefits because they only offer coverage for same-sex domestic partners.

While I appreciate their progressive stance and understnad their offering this to same-sex domestic partners because they cannot legally marry I also would like to take advantage of health benefits for my domestic partner and I feel that we are being discriminated against.

Is this lawful discrimination or can I sue to get health insurance coverage for my opposite-sex domestic partner?

This is not a family law question, but I was puzzled when I saw the law and wondered when someone would challenge it.

It seems to be unconstitutional, or at least a violation of the Unruh Act.

It would be worth consulting counsel on this issue. If it qualifies for class action, you would not have to pay for atty fees.
