Legal Question in Family Law in California

Employers Failure to Comply With wage Assignment

I need to know what my rights are when I have a order to withhold wages from my ex but my ex's employer is not sending me checks. They are taking the money out of his paychecks on a weekly basis but not sending me any money like they are supposed to. This wage assignment has been in effect for several months now but I have only received a cuople of checks from them. Also if they don't take out the correct amount for whatever reason, are they responsible to go back and take out the differene from later checks?

Need to advise her employer that you will set an OSC hearing and send them formal notice of that hearing. They can be made subject to a contempt order by the court. Retain counsel to assist.
