Legal Question in Family Law in California
Enforcement of property agreement on Summary Dissolution
I have a divorce decree (done by summary dissolution) which includes a property agreement. The property agreement states my ex-husband is suppose to pay off 1 of our credit cards (in my name) & an additional $50/mn for 1 year. He has barely made a dent in the bills and is now refusing to pay me. Right now he owes me about $1,500 (no including interest accruing)Basicall my question is: What forms do I need to file in w/family court to have this property agreement enforced, including a wage garnishment? He lives in Illinois now, but the order is out of San Diego County. I asked a clerk down here but she didn't know what forms to give me. Any help would be appreciated!

File a motion to determine the amount of arrearages, and request an order for the full amount that he owes you. If the court has jurisdiction and makes an order setting the amount that he owes you. Then you can take steps to attach his wages or bank accounts.
