Legal Question in Family Law in California

Engagement ring

I bought a $5400.00 engagement ring and proposed to my fiancee'. After 2 years, I have given up and ended the relationship. I cancelled the wedding a year ago.I am pursuing getting the ring back through small claims court. Do I have a chance??? Is there a concrete law??She refuses to give the ring bacjk even after I agreed to pay $3300.00 of her bills off on Sept. 9, 2001. That day, I asked her for the ring and she said she was NEVER giving me the ring back, that it was a gift. I say it was a contract and since we never married, the ring should be mine. Help!!!!!She has probably 4000.00 more in jewelry I am NOT trying to get back.

Re: Engagement ring

It was a contract and if she breached the contract, refused to marry you, she should give the ring back. You gave her the ring as a token of your promise to marry her, but you breached the contract, not her. If you are in front of me as a small claims court judge, you lose. Good Luck, Pat McCrary
