Enullment vs. Divorce

Do I still file for divorce, if spouse was married before and never obtained a divorce?

It depends on whether you want spousal support or not. If you want spousal support, then you need to file for a putative divorce. On the other hand, if you are concerned you might have to pay for support then you will want to file for an annulment and partition.
