Enullments vs. Divorce

Do I still file for divorce, if spouse was married before and never obtained a divorce?

You should file a petition to have the marriage declared void. That way you can be sure that a future marriage will be valid. If you were in this relationship for a number of years and obtained property, the court may treat you as though the marriage was valid solely for the purpose of dividing property and support. You should discuss the facts of your case with an attorney.
