Legal Question in Family Law in California

Equal custody: move child out of state?

We currently share legal and physical custody. Due to my shift work, I spend less quality time with my child, while day-sleeping. I have an opportunity to work business hours, which would make me regularly available for my child for the first time. There would also be a pay raise. My current job is going to be phased out, but not yet. The new job is on the east coast, both parents live in CA. I encourage visitation, but know it would result in less than half time for the other parent, due to school year. How can I make it work?

Re: Equal custody: move child out of state?

I am not sure that you can make it work. While you are improving your relationship with the child, you a harming the other parent's relationship and the child needs two parents. You will need the permission of the court to move the child out of state. There are many factors involved for the judge to consider. Get a consulation with an attorney who is familiar with move-away motions before you make any decisions. Good Luck, Pat McCrary
