Legal Question in Family Law in California

My estranged husband recently had a child out of wedlock. He has never worked due to his addiction to drugs & alcohol. The other woman says she is going to get child support through me. I have two children already and I haven't even seen the child. Is this true, that I have to pay child support?

Mr. White is correct unless you have any accounts that your husband is on too. Joint accounts can be used to satisfy most debts, and certainly child support, but your income is not available to calculate or pay child support for a child that is not yours if you keep your income in a separate account. You should close all joint accounts and open new ones if any joint accounts exist, and it sounds like its probably time to turn "estranged" into "ex" as soon as possible.

I agree with Mr. McCormick. Your community property could be liable, to satisfy the debt, but you would not be personally liable. To protect your earnings, they need to be placed into an account in your name only, that your estranged husband would not have a right to withdraw from.
