Evicting a spouse

We are living in a house owned by my step-mother. We have filed for a divorce. I have let my spouse live rent, utilities and groceries free you the past seven months, so that he can save money to get his own place. He is not saving and is refusing to move out. In December I gave him a written notice that he is to be out by Feb. 1, but that time has now passed. How can I legally get him out of the house?
