My ex-boyfriend and I have a child who is 9yrs old. 3 yrs have past and I am now ready to move on with someone new. He is in the military stationed in Miami. He has asked for us to move in with him so that we may begin a new life together. Before doing so I would like to cover what I may have to encounter if my ex should argue this move. There has never been a court order. We've never discussed time but you could say we probably share equal time with him. My son is very much aware of what my plans are and definitely wants to live with me. Please advise when I should tell him and what I may need to do if he should fight me on this. The most sensible thing to do is to file a petition for paternity and a motion to establish that you are the primary custodial parent. You also should be asking for child support.
