Legal Question in Family Law in California
My ex-boyfriend and I have a 7 month old child together, he signed the declaration of paternity in the hospital. He is currently in jail in San Bernardino County, CA on a probation violation/revoke hearing. He doesn't have a drivers license, it has been suspended for several years and he has 1 DUI which he hasn't taken the Alcohol classes he is supposed to take per probation(one of the reasons he is violated) and to get her license back. I am planning on filing for custody and since he hasn't been very involved in our daughters day to day life, I'm asking for sole physical and legal custody with visitation for him. My concern is his lack of drivers license in case of an emergency involving her daughter. Is this something that I can bring up in to support him getting limited visitations or would it not matter?

That is a very relevant point, as is his entire history of irresponsibility and substance mis-use.
