Exclusive Use of Home
I�m going through a divorce. What�s the definition of attorney harassment? My estranged husband is living in & trashing the inside of our motorhome while we�re going through a divorce. He's not maintaining the engine, drive train, tires, to the point the motorhome is no longer safe to drive. Is this considered wasting an asset?
Our OSC hearing is next Monday. In his declaration he asked to come back to our small, 876 sq. ft. condo that has 2 bedrooms & 1 bath & he wants exclusive use of the master bedroom & bathroom. He�s asking for me to move into the second bedroom that does not have room for even a twin bed because it was turned into an office.
He�s currently out on bail with 2 felony charges. Prelim. hearing is Sept. 20th, strong possibility he�ll do time. He�s been out of the home since mid-March. Because of his criminal action I�ve asked for exclusive use of the condo. If he�s allowed to return to the home I am afraid he will pressure me, coerce me, threaten me, & try to force me into being a witness in his upcoming trial. There�s been no physical abuse yet, but it�ll happen if he returns. I�m really scared. Will a judge allow him to return knowing about this? Please answer all 3 questions. Thanks!

The only advice I can give you is to get a lawyer!! Too many complicated legal issues involved in this one.
