Legal Question in Family Law in California
Ex-husband lost job...child support
My ex-husband lost his job in March of 2005. Our settlement agreement stated he would pay $900 per month (garnished) for our two children's support. Since he lost his job he does pay something every month (usually around $400) but last month only paid $50. He's working odd jobs and there isn't any way I can prove his salary. All his other bills seem to have priority over his child support. This is making it difficult for us to afford to live in So. California. I was ordered not to take my kids out of L.A. county. If he isn't paying his fair share of child support, would a judge possibly let me change our agreement so that I can move to a more affordable area...even out of state?
Thank you!

You should get a court date immediately to: 1. Get your husband to pay, and 2. Ask about taking child to more affordable area.

You should retain a lawyer, especially if you are contemplating a move away. With respect to support your ex is in contempt so you really should file an OSC right away. I would not try this without a lawyer.
