Legal Question in Family Law in California

Ex-Husband threatening to break Divorce Agreement

To make a long story shorter, after a bitter fight over custody, we agreed for my Ex-Husband to have custody of our son, I have visits over the summer, spring and winter breaks. They live in Chicago,I am in CA. Our divorce was done in Chicago. Per this agreement, this summer our son is to come live with me permanetly with my Ex receiving the same visitations I had. He is now threatening me to not send him this summmer, and said he lawyer has told him this was ok. What can I do? Can he legally not send him? Will this court battle have to be done in Chicago where he lives? Since this is a court order, isn't he legally binded to send my son? Would a court change our agreement because this is what he wanted?

Please help, I feel like I have no rights because I don't have custody.

Re: Ex-Husband threatening to break Divorce Agreement

If he does not send son for the summer visitation you will need to address that in Chicago. Jurisdiction remains in Chicago so long as your ex lives there.
