Ex-husband threatening court action over child's diet

My ex-husband of five years is threatening to take me back to court over custody of our 9 year old daughter because when she is at my house she sometimes eats at fast food restaurants or has junk food such as donuts. He is a health food nut and wants to dictate what she can and can't eat, even when she is with me. Would he get anywhere with this argument in a CA court? We currently have joint custody. She is with me 4 days a week and him 3.

Probably not. Unless her diet at your house is interfering with her health (is she always sick, and hence missing time with him? Is she 35 pounds overweight?) and is not in violation of your court orders, you probably have nothing to worry about. That said, custody matters are never to be taken lightly. Is there a middle ground? What exactly is your ex concerned about? Is there anything you could do to change things that would make him quit threatening to take you back to court? A little fast food is no big deal, but if stopping for a chicken sandwich instead would quiet him down, it might be worth it from an aggravation standpoint alone. Good luck.
