Legal Question in Family Law in California

How to expedite a divorce

My fiance and his ex have been separated for nearly 4 years, and cannot settle on an agreement regarding their property. His ex's lawyer continues to post pone settlement and court dates. My fiance is desperate to have this divorce finalized, but does not want to lose everything he has worked for. His ex is asking for the entire house, without buying him out. What can he do? Can he talk to a judge to get a court date booked ASAP? He has been paying spousal support longer than half of the duration of their marriage, because they are still legally married. That is why his ex and her lawyer continue to push this out. There has got to be something my fiance can do to end this, and not lose everything. Pelase advise..

The parties need to settle on how the property is going to be distributed first before the divorce can be final.

I would suggest that your boyfriend consult a Family Law Attorney and work towards a quick resolution if possible.

He can request that the dissolution process be bifurcated. That is that the marriage is dissolved and the remaining issues be reserved for later resolution. This may break the log jam and get the property settlement completed.
