Legal Question in Family Law in California
Hi, I was expelled from home more than a yr ago; my 9 & 10 yr old children miss me and I miss them, I my ex is receiving great amount for child support based on the fact that "I don't visit my children"... Problem: my ex wont let my children see me nor will answer my phone calls to coordinate visitation. I am entitled for visitations rights?

Child support is based on how much court ordered visitation time you have. The more time you have with the kids, the more the system assumes you spend on them while they are with you, and the less it costs your ex, so you pay the ex less. So if you are paying support based on no visitiation then you presumably must have no legal visitation rights. So of course your ex isn't cooperating. If you want visitation you need to go back to court and request a modification of the custody orders to give you visitation and then modification of support based on your new custodial time.
