Expertise on a child support issue

My husband use to be married. He has two kids from previous marriage, and continuously had paid child support to his ex wife.

10 years ago his ex wife, re married again, and now she will be getting a divorce officially in 6 months, they filed already. My husband's ex wife, is now asking my husband now to pay for their kids medical benefits. Can she legally make him pay for this? He already pays child support? Approx 1000$ a month. Why cant my husbands ex wife ask her most recent husband to pay for it? My husbands ex wife has been married to this man for 10 years.

The kids are currently on her husbands plan. I feel that my husbands ex wife, is taking advantage and makes my husband incur more and more expenses when maybe she should hold her current husband accountable after 10 years of marriage.

Well, usually the law doesn't make one man pay for another's man's children. However, just because she wants him to pay for insurance doesn't automatically mean he will have to pay it. You should see an attorney for a consultation regarding your case.

California law requires him to provide medical insurance if it is provided through his or her employer, at little or not cost. Further payment of a portion of the uninsured medical costs for the children is routinely ordered by courts as additional support.
