Legal Question in Family Law in California

Extremely Frustrated

My ex-husband-to-be gave me a vehicle as a gift. I submitted the title and it was returned by the DMV for lack of info and more fees must be paid. Change of ownership has been a real mess from the start. Release of Liabilty was signed by my husband as the buyer. When I got back the paperwork, it stated that I am the registered owner. Right now, who would come up as the legal owner-the previous owner, my husband or myself? I ask because my husband had some work done on the car and now refuses to give it back until I write and sign and get notarized a document stating that I do not want one thing from him in the divorce settlement. Two people told me, including a social worker, that what he is doing is a form of blackmail and that is completely illegal. True?

Re: Extremely Frustrated

From your description of the events it would appear to be extortion, blackmail, you should file a motion with the court in which the dissolution case is filed requesting that he be ordered to immediately give you possession and conotrl of the vehicle.
