Legal Question in Family Law in California

Ex-wife won't adhere to marital dissolution agreement

Are the terms of marital dissolution agreements legally binding? My ex-wife refuses to refinance our home in compliance with the agreement we signed four years ago, and it looks like legal action is my only recourse to get my name off the existing mortgage. Can I force this issue in court?

They are binding and most courts will order a souse to sign any document needed to cary it out. if she doesnt sign she goes to jail until she does.

Re: Ex-wife won't adhere

We would need more info about what the judgment says. If it says she must "try" as opposed to "wife shall remove husband's name from the mortgage through refinance and, in the event such is not possible, through sale of the property"....you see what I mean?
