Ex-wife was arrested, we have joint custody

Ex-wife was arrested, we have joint custody(Monday to Monday). She was arrested while kids were with her on her week. Ex-wife lives with her Mother. While being arrested the kids left with Grandmother. I asked the Police at this time if I could take my kids and they said''the Mother has a right to leave the kids with a baby-sitter(Grandmother)while she is in jail. My question is how long can the baby-sitter(Grandmother) have the kids for before I can take them? Can a parent that is in jail make decisions about their children while incarcerated or does/can the other parent(myself) take over control of the children? Please HELP!

you can go to court and ask for an order allowing you to take the kids back.
