Legal Question in Family Law in California
Factors in determining support for divorce in California
Is there a provision in the formula for determination of support, or any applicable (since the current formula became law) case law, that demonstrates inclusion of the following factors in determining support in California?:
- value of marital assets available to party seeking support, particularly highly liquid assets (stocks)
- refusal to seek work by party seeking support
- relative proportion of contribution of marital assets by each party
After all, if one party REFUSES to work, and is GIVEN several hundred thousand dollars in marital property contributed SOLELY due to the labor of the other party, it hardly seems fair that the court should disregard all that and FURTHER burden my family member to provide support, essentially rewarding one party for refusing to lift a finger, while the party that has worked to produce ALL assets is punished by further demands for support.

For factors to be considered in awarding spousal support see Family Code section 4320. You can find that law using my web site at www.sbdivorcelawyer.com.
