Legal Question in Family Law in California

false marital status on child support

My ex denied being married on child support docs when in fact is married. (Failed to add husband's income) Basically lied. How can I use that in my favor?

You should file a motion to modify child support and in determining the income matters you should include that information to modify it.

good luck.

As always consult a qualified attorney in your area before proceeding.

Re: false marital status on child support

The income of the new spouse is used only to determine the amount of income taxes she pays. Often the amount of child support could increase by including the new spouse income. Her income tax may increase. This would decrease her spendable income and increase the amount of child support. Before filing a motion to modify child support you should consult with an attorney or run the child support program to determine whether child support would increase or decrease and the approximate amount.
