Family Law - argument for ''No valid marriage license''

If I had a marriage ceremony, but do not have a marriage license, what caselaw can I use to win my divorce case?

If your ceremony was in California, no license no marriage. Family Code � 300. If you aren't married, you can't get a divorce. What you should consider is to get an order determining the invalidity of your marriage, that will help ensure that can get a marriage license to issue in the future for another marriage, that there is no dispute about the validity of a subsequent "marriage," that you avoid some unknown "heirs" claim against your probate estate/trust estate in the future, etc.
