Legal Question in Family Law in California

family law

My baby's dad and me separated and I'm thinking of moving out of state with my 11 month old baby. Can you tell me if I can move without any problems with my ex.

Re: family law

Depending upon the circumstances you may be ordered to return the child to California pending the custody and visitation hearing. You should consult with an attorney before moving generally the best approach is to either get father to agree in writing or a court order allowing the move.

Re: family law

If you have primary custody you can move, so long as you inform him where you are going. Otherwise that would be considered kidnapping.

Good luck. As always please consult a qualified attorney in your area before proceeding.
