Legal Question in Family Law in California

Family Law Billing Ethics?

Can an attorney make a lein for his or her fees of the assets or amount of money which maybe collected or recovered from the opposing party?

The concern here is that there is an incentive to keep the clock spinning indefinitely to run up huge amounts of time and to engage in unnecessary litigation in order to realize higher fee amounts? i.e. endless litigation!

Isn't this unethical or illegal?

Propose a settlement offer. You might want to read Family Code Section 271.

Re: Family Law Billing Ethics?

Contingency cases are not ethical in family law matters. If you are unsatisfied with your attorney you should express your concerns and if appropriate fire them and hire a new one whom you are comfortable with their billing practices.

As always please consult with an attorney before taking any legal steps.

Good luck.
