how can childrens protective services take somenes children away from her for reporting a sex crime on one of her children and how can they charge her with ''failure to protect'' whenever all she was doing was trying to protect her children

The theory is that you did not protect the molested child, or if the molester was living with you that you will allow the molester access to your child. You should consult with an attorney with experience in juvenile court dependency cases.
