Legal Question in Family Law in California

Family Law, Custody

I have sole phys. and leg. custody of our 12 yr. old son-I live in MI- my ex has joint phys. and leg. with me of our 13 yr. old daughter, she lives with him in CA. I found out from her that he is going to try and get sole custody of her, but he would lie to the court saying he doesn't know where I am, and that I have no contact with her- I talk to her every single day- what do I need to file in order that he can't lie to the court? Could I get 6 months with each of us since we live far apart- would the court consider it? What do I need to file to do this, and would I have to be in CA to do so?

Re: Family Law, Custody

You can retain an attorney in california and during the hearing you can make telephonic appeareance. You should file for the modification of custody and visitation arrangement before your ex does. Where is your case?
