Legal Question in Family Law in California
Family ?Law
I am getting a divorce.
I purchased a jet ski through a finance company in my name only before I was married and put my boyfriend's name on the registration at the time. We got married and now he claims he has right to half of the jet ski. I paid the ski off in full in my name. He made no down payment but made some monthly payments. I am willing to pay him back for the monthly payments he made. He wants to take the jet ski. What are my options?
Also, I purchased a home 6 years before I was married and had my husband sign a Quitdeed Claim stating he gave up his rights to all community property and it is my sole and separate property. He now wants money from the house. We have been married for 1 year and 8 months. What are his rights? There are no home improvements.
We both purchased a Truck before we were married. I am the co-signer of the truck and made a down payment with him. We got married and I paid the truck off with money from my home. What are my rights for reimbursement for the truck? Thank you.

The potential amounts of money involved in your case make it advisable that you consult with an attorney regarding your rights and his rights.

Jet Ski: Even though you bought the jet ski before marriage, it sounds like you made payments on it after the marriage, using community property income. Therefore, your spouse is entitled to at least part of the value of the jet ski.
Your husband is entitled to a pro rata interest in the house based on the value at the time of marriage, the value at the time of separation, and the amount of money that went towards the principal during the marriage. It's an equation that helps to determine the amount a spouse is entitled to if community property payments were made on a house owned by one of the parties as separate property. Considering that you were married for 1 year and 8 months, it won't be much.
Truck is a little bit trickier, and I'm too tired to finish. :)
