I've been divorced since 2005, The ex and I share joint legal custody the children reside with me. The plan was for him to have the children every other weekend from Friday @ 6:00 p.m. to school time Mon morn. 3 months after we divorced him and the new wife stated it just wasn't working out for them here and left. Is it possible for me to change the child support order, because he is with them zero % of the time and with me 100% of the time. I would also like to be able to claim both boys since it is evident who is head of the household here.
My boyfriend has taken us all in at his home and we are good and the kids are quite stable and happy. Would my ex still have to pay child support if I went for full legal custody and if it were changed would he have to pay all the back support owed?

Yes, you should file a motion to modify the support and the child sharing schedule. You should receive a modification as the time share has changed and that is one of the factors that the court uses in determining the child support. Good Luck, Pat McCrary
