Legal Question in Family Law in California

Family Law Problem:

A former couple residing in Arizona has a 5 year old son. The mother had moved to AZ when the child was 2 or 3 in for school and to start a new life, at that time, they were engaged. They have not been a couple for over 2 years and they both still live in AZ. The mother has since graduated school and is interested in moving back to California. They have joint custody. The father is taking the mother to court to keep her and their child from moving. Up until now, they have had a good relationship as parents. It is also important to note that she stayed as long as she did so that the father and the son could be close. She can not afford representation.

Note: she is NOT trying to flee with the child nor is she trying to keep her son from seeing his father, she just wants to move back to CA, close to her family and friends.

Questions:

1. What actions is he most likely taking (motions filed etc) in order to keep her in AZ and what can/should she do in preperation for these motions.

2. What should she do in order to have permission to move back to CA with her son?
