Legal Question in Family Law in California

Family Law >> Southern California >> I'm in the Dissolution of Marriage process in Southern California, I have discovered that my spouse is going to sell the marital home. In California this is considered community property, and Per Standard Family Law Restraining Orders stated in FL-110 this action is forbidden without my written consent. I'm a military spouse of 9 years and have been a stay at home father, I'm not on the title of the home. I'm about to file an Ex-Parte asking in the Declaration for Cease and Desist for Property Control. Is this the correct Request for Order in this situation ? I can't afford a lawyer at this time due to no spousal support, a sever knee injury, and I have been paying my child support. No negotiations have taken place regarding this matter, and I plan on attaching and sending a request of FORMAL MEDIATION to other parties self and counsel. I real could use some advice.

You need to contact the Family Law Facilitator or Family Law Self Help office (or whatever similarly titled office exists in the county where the divorce is pending; there's one attached to every county court). They can help you with figuring out what papers you need to file and how to get them filed and a hearing set in their particular court. You should also apply for spousal support and to have her ordered to pay some part of attorneys fees for you so you can get counsel.
