Legal Question in Family Law in California

family law

I voliated a restraining, was arressted,

but was never read the miranda rights.

Also I was charged with drunk in public,

but never given a breath,or sorbritiy or

blood alochol test! Can I get this case

dismissed ?

The police are not required to give you your Miranda rights before arresting you. The location of your arrest may be all of the evidence required for a conviction. As to the drunk in public, the police officers testimony can be sufficient for a conviction. An attorney reviewing the facts in your case may be able to devise a defense.
