my ex wasted the community by leading us into bankruptcy in the amounth of $87,000 due to his gambling debts, losing a rental property for the same reason, almost led us to lose the family home (which I rescued and he later quitclaim to me). We then bought another property and later split. He stayed at that property for 3 and half years and after having to quitclaim the other house to me stopped paying the house he kept and was almost foreclosed. I moved into the property and saved it from foreclosure but now need to sell it but I can't continued to make the payments and he won't quitclaim the property to be refinanced to lower the payment and put it for sale. Would the court allow me to pursue the refinancing and force him to quitclaim the house to me?

You should file a motion to obtain a court order that you can sell that property. If you want to retain the property ask for an order that allows you to buy the house. This should allow you to obtain refinancing. You should also request reimbursement of the costs of saving the property from foreclosure.
