Family law

My ex and I have a 6 year old daughter. He is from Sudan and this summer for one month he is planning to take her to Sudan. I'm afraid that what if he won't bring her back. How can I prevent this from happening?

Re: Family law

This is a difficult and time senstive question. I suggest you immediately locate a lawyer in your county in case you need to file a motion.

The first question is whether there are orders allowing or preventing this type of travel. If so, they will be your starting point. There can never be a guarantee on return, but there must be an element of trust. You will want to dteremine if Sudan has signed off on the Hague Treaty, so that a court there will force the return of the child in the event of a hold over. In any case, you must be prepared to go to court well before the trip in order to determine safety and safeguards for this trip and the return.
