Legal Question in Family Law in California

Family Law/Appeal

I had a ruling go against me in family court in September, 2007. I did not know that I had 60 days to appeal the judges decision until recently. How can I go about it to get back into court and get my rights back as a parent and perhaps have another judge review my previous case? Thank you, L. Davis

Re: Family Law/Appeal

You may have as long as 180 days to file a notice of appeal (depending on whether there was service of notice of entry of the order or judgment). Those 180 days would run from entry of the order or judgment. If that was in September, 2007 you are out of luck. But without reviewing the file I cannot ascertain when the order was entered or whether there was service of notice of that entry. Did you have an attorney who can answer these questions?

I am a certified appellate law specialist with much experience in family law appeals. If you would like me to attempt to determine whether you still have time to appeal, please forward to me the case name, location of courthouse, and case number. Further, because every day of delay could cost you the right to appeal, you should consider filing the Notice of Appeal immediately.
