if i lost custody of my kids 3 years ago, and am having another soon, can they take it even though i see my kids all the time, and the circumstances have changed, also i am in the process of regaining custody?

Maybe, it is hard to really give you a definitive answer without knowing exactly why you lost custody of your children 3 years ago. I think that you probably have a good chance of keeping the newborn considering you are in the process of regaining custody of the other children. This seems to mean to me, at least, that the circumstances have changed as you mention in your post. You may wish to discuss your details with an attorney.
