Who is in control of my moms financial martters when there is no power of attorney present at this time? her brothe or her children?

Neither. Your mother is in control until the court rules otherwise.

Neither. If your mom is unable to manage her financial affairs and she has not executed a trust or power of attorney, then a family member will need to petition the court to be the conservator. If no family member is willing to petition the court then Big Brother will do it and become the conservator of her estate, meaning the government will take everthing she has.
