Legal Question in Family Law in California

Family Services Rights Abuse ?

Can Family Services without a court hearing and or trial take my visitation rights away? In my divorce papers that where influenced by Family Services. It basicaly says that to see my son I have to complete 18 months of a sexual abuse program. This was brought about on false acusations that could not be substanciated or proven in court! Have they violated my civil rights? I was arrested back on 11/1999 but they changed it to a detention. And Family Services has used it to keep me from contacting my son.

Dear Inquirer:

Nothing herein shall create an attorney-client relationship, unless a written retainer agreement is executed by the attorney and client. This communication contains general information only. Nothing herein shall constitute an attorney-client communication nor legal advice. There likely are deadlines and time-limits associated with your case; you should contact an attorney of your choice for legal advice specific to your personal situation, at once.

If you haven't already done so, please visit my

web site at --

The site contains quite a bit of general information about California Family Law, Tenants' Rights, and Juvenile Dependencies, and EDD hearings and appeals, as well as information about me (education, experience, et cetera) and my office (location, hours, fees, policies).

NOW, IN RESPONSE TO YOUR INQUIRY --

The facts that you have provided are not clear

enough and/or complete enough to provide a

definitive answer to you inquiry; however, I would

say that if you already have an "exit order" from the Juvenile Court it may be modified in Family Court. If the case still is in Juvenile Court, the visitation order and/or the service plan may be modified there by contested hearing and or WIC 388 petition.

Thanks for sharing your question.
